Chapter 1: The Number Everyone Panics About

5 sources. Checked September 2026.

Every claim in this chapter is traced to the source behind it. Below is each one, numbered as it appears in the book, with a link that opens the original.

  1. Care Act 2014, section 14 gives councils the power to charge for meeting eligible care needs, up to the cost of providing them. Section 17 requires a financial assessment before any charge is made, with the result given to your parent in writing.

  2. NHS-funded Nursing Care weekly rate. From 1 April 2026, in the 2026/27 year, this is £267.68 a week in England. Check the current figure at [ageingparent.co.uk/s/fnc-rate-2026-27](https://ageingparent.co.uk/s/fnc-rate-2026-27) — this changes each April.

  3. Care and Support (Charging and Assessment of Resources) Regulations 2014 (SI 2014/2672), regulation 12 and regulation 25\. In the 2026/27 tax year, the upper capital limit in England is £23,250 and the lower capital limit is £14,250. Between the two limits, £1 a week is added to the assessed contribution for every £250 of capital. Both limits have stayed the same since April 2010\. Check the current figure at [ageingparent.co.uk/s/si-2014-2672-reg12](https://ageingparent.co.uk/s/si-2014-2672-reg12) — this changes each April.

  4. Care and Support Statutory Guidance, Annex E, "Deprivation of assets." Sets out the test a council applies: whether avoiding a care charge was a significant reason for the gift or spending, and whether your parent could reasonably have expected to need care at the time.

  5. Care and Support (Charging and Assessment of Resources) Regulations 2014 (SI 2014/2672), regulation 22, "Notional capital." Regulation 23 sets out how a notional capital figure reduces over time. Together, these let a council treat given-away money as though your parent still had it.
