Chapter 4: The Parent With Nothing to Assess
4 sources. Checked September 2026.
Every claim in this chapter is traced to the source behind it. Below is each one, numbered as it appears in the book, with a link that opens the original.
- Care and Support (Charging and Assessment of Resources) Regulations 2014 (SI 2014/2672), Schedule 1, paragraph 8, on the income taken into account in a financial assessment. The mobility component of Personal Independence Payment or Disability Living Allowance is always excluded. Attendance Allowance has no mobility component to exclude. Only the care, or daily living, component of any of these benefits is included.

From 1 April 2026, in the 2026/27 tax year, the weekly rate is £31.80. This figure is set by an annual amending regulation, most recently the Care and Support (Charging and Assessment of Resources) (Amendment) Regulations 2026, rather than fixed permanently in the original 2014 regulation. Check the current figure at [ageingparent.co.uk/s/si-2014-2672-reg6](https://ageingparent.co.uk/s/si-2014-2672-reg6) — this changes each April.
www.legislation.gov.uk/uksi/2014/2672/regulation/6 - Care and Support (Charging and Assessment of Resources) Regulations 2014 (SI 2014/2672), regulation 7, "Minimum income guarantee." The amount depends on your parent's age, Pension Credit age status, whether they are part of a couple, and any disability premiums. In the 2026/27 tax year, a single person who has reached Pension Credit age is left at least £241.45 a week; a single person aged 25 up to Pension Credit age is left at least £120.40 a week. Ask your parent's council for the figure that applies to their exact circumstances. Check the current figures at [ageingparent.co.uk/s/si-2014-2672-reg7](https://ageingparent.co.uk/s/si-2014-2672-reg7) — these change each April.
www.legislation.gov.uk/uksi/2014/2672/regulation/7 - Social Security (Attendance Allowance) Regulations 1991 (SI 1991/2740), regulation 7, on Attendance Allowance not being payable where a local authority is meeting some or all of the cost of a care home stay. The same payability rule applies to the care, or daily living, component of Personal Independence Payment and Disability Living Allowance. Regulation 8 sets out the 28-day exemption: Attendance Allowance continues to be paid for the first 28 days, and a gap of 28 days or less between stays is treated as continuous. Ask the Department for Work and Pensions to confirm the exact date for your parent's own case. Where a care home place is fully self-funded, Attendance Allowance continues to be paid as normal.
